    As a recovering alcoholic, this month was 31 years, I've been drunk behind the wheel far too many times. Really had no thought of it till it was too late. Anyway, I'm glad you weren't hurt and I apologize for my fellow drunkards. I hope you don't get screwed anymore than you already are yet it is easy for our oldies to be totalled for actual cash value--which ain't much in the insurance companies tables. You may have to get some sort of advocate, however, in my experience since the ins. companies are so similar and tightly regulated they are all going to screw you about the same with the government's license.

    I just had my Jeep rear ended. My brother and our dog were doing about 30mph. Fortunately nobody was hurt except for some stiff necks. Got a cash settlement however the bumper and mounts are long since NLA--only made for one year. At least the estimator said he recognized it as a rust free collector's item and said he'd do everything he could not to total it out. Some humanity from the estimator yet I wouldn't expect it from the insurance company.

    The other party is TOTALLY at fault for hitting your legally parked van! His insurance is legally responsible to make you whole again.... that is, to cover every expense and inconvenience you incur in getting you into a van that was as straight as the one he wrecked......The insurance company of an "at fault" driver does not get to make the rules--- YOU DO!
    My suggestion would be to replace the van on your own and FILE SUIT for the full replacement cost, as well as towing, storage, personal transportation (rental car) costs and interest costs up to the time they settle.
    Your choice to have liability only is irrelevant to this accident and the treatment you should expect....The adjuster that told you that you'd be last in line is a moron! Ask for that in writing, and then work your way up the chain until you get somebody that is willing to be helpful..... Also, ask for a "collector car" adjuster rather than some yutz that just wants you to settle cheap!

    Don't let the insurance company scam you out of your money. Your liability insurance covers the other person should you be at fault. In this case, the other person is at fault and her insurance should pay you for your damages to the extend of her coverage. When her insurance has spent all the money to the extend of her coverage, any additional losses will have to come out of her pocket. I agree with AzDon, If you want to avoid a headache I'd suggest you hire a lawyer and have them deal with the insurance. Sorry about your van, hope you get paid off an get another one on the road soon!

    Their first offer is not their final offer, they will try to low ball you don't let them get away with it. That money should be in your pocket not theirs.

    they still should be on your side that is what you pay them for...

    Your insurer isn't likely to help because you only bought liability and this accident doesn't involve any liability on your part....
    The offender's insurance will try to pay you so-called "market value" based on comps acquired by a third party called "CCC Valuescope". It's well documented that Valuescope places phony ads on Craigslist to seemingly support their lowball values.... People that have tried to verify valuescope's
    comps have been unable to find that any of the comp vehicles actually exist, let alone being for sale....
    Since you are in the San Diego Area, I suggest just "throwing down" for one of the suitable vans that is available and then insisting that they re-imburse you.... At the very least, you should copy any and all LEGITIMATE ads for similar replacement vans and make them PROVE any of their comps that come in low-ball....They have an obligation to either fix yours as it was before the wreck, or pay you the amount of money it would take to replace it....You also have the right to buy back the salvage in the transaction, but they'll insist you get a salvage title in order to let you keep it.....I got paid $14700 plus the salvage by the at-fault party's triple-a insurance on a 62 Chevy pickup that was liability-only insured, even though I'd just finished a frame-off resto-mod...... I lost a bit of sleep before they paid, but, ultimately, I prevailed by demonstrating the value with "real" comps and insisting that we'd meet in court if they refused to face pricing reality!
