Do you think that the Police has or should have the right to violate our U.S. Constitutional rights at a D.U.I check point?

I think the kid gave him enough reason to conduct sobriety tests. It could have been much worse, I have seen cars interiors ripped to shreds by officers looking for drugs that a dog 'hit' on. None were found and nothing was given for damages. What I dont understand is someone who will waste the time of several officers, who are paid by our tax dollars, just to prove a point. keep in mind that we are only seeing his side of it and we dont really know if he was cited for anything or not.

I know a guy in the Army who was ordered to paint the barraks. He was given a brush and five gallons of paint. He painted a spot one square foot all day long. He knew they couldnt do anything to him because he did follow orders, he was just like this kid, proving his point. What an accomplishment!

I posted this because a couple of weeks ago I was stopped at a Seat belt checkpoint I was asked to provide my drivers license & proof of insurance which I did. I was then questioned as to where I was going & where I was coming from along with a lot of other questions that I believed was not their business! I answered all of their questions. Later on I started thinking that the officers had no right to question me. I have decided that in the future I will not answer any questions except any pertaining to the check point. I was not pulled over for violating any traffic laws just simply stopped at a seat belt check point. I was wearing my seat belt & showed the officer upon his request.

Handi, he was probably just getting a better look at your van!Smile  He may have ASSumed that being and older van, it might not have seat belts. I always try to be polite so as not to "bring on" any more hassle than is necessary.

NO I do not believe in check points as far as i'm concerned it's intrapment. BUT they get away with it if they put a notice in a local news paper stating when and where. PS. and i havn't drank in 20 years...

Here is a perfect example of the protection that our sheriffs department gives us in Whitfield County Georgia!!!

This picture was taken at an entrance ramp on I-75 in Whitfield County.
The sheriffs department had a total of 10 Whitfield County Cars on the interstate that day catching speeders.

Y'all would understand my problem & frustration with the county police doing this if y'all came home from work one day to find that your house had been broken in to & thieves had stolen everything that you had worked for all of your life while the police was out running radar on the interstate or having a seat belt check point & harassing the law abiding tax paying citizens & while they are out doing this thieves are out breaking into our houses.

I call it bringing in revenue. The police stations are ran like any other government supported structure... to bring in income. Tickets equal income. Anyone notice how towards the end of the month i.e. quota time... tickets out the ass! Its the peasants like us that pay the bills and they harass us law abiding citizens as part of "doing there job". A slow brainwashing of society in that someday we just lay down and do whatever they want. The general public says nothing out of fear and then the police/agencies become comfortable running over our constitutional rights, edging in the slow degredation to the foundation of the united states constitution. Society these days SMH. We need more backbone! Turning our heads is just as bad as being anti constitutional. I guess being from Texas I have that come and take it attitude, I have no problem exercising my rights these days because people forget.

Here in the state of Georgia a holder of a concealed weapons permit does not have to show the police their concealed weapons permit & they don't have to tell them if they have a concealed weapon in their vehicle either. When your drivers license & tag is ran all information that you are required by state & federal law which consists of a valid driver's license, proof of insurance & proof of current vehicle registration which is already in the state department of transportation's database including info that you are licensed to carry a concealed weapon. I don't ever offer any other information in a traffic stop or a check point! It's just like you said the Cops says if you don't show me your gun I won't show you mine. That's why I don't ever tell them that I am carrying one. I have found that if you offer the information that you are carrying they will hassle you!

here in washington state- when the police run your dl & plates for any purpose- that info is automatically shown(weapons premit) I have asked the police about that also= been told =its best to be honest & up -front with any police officer- due to when they see that report-it makes a question mentally to them- is he carrying? Why didnt he let me know he had one? Then -the officer gets nervous-and here comes the additional questions for ya too. OOPS!affraid

If you don't tell them that you are carrying you have not lied to them. It is perfectly legal in the state of Georgia to have a registered weapon in your vehicle as long as it is visible. I have a concealed weapons carry permit so I can carry a weapon in my vehicle hidden whether it be on my person or hidden in my vehicle. If a person wants to inform an officer that they are carrying a weapon it is voluntary they are not required by law to do so. I am sure that a lot of times that I have been stopped either in a traffic stop or at a check point the officer wondered if I was carrying but he knew that by law I didn't have to tell him. I have just found from first hand experience & from other people's accounts of providing that information voluntarily that you are more likely to be harassed by the Cops.

cops must be opposed to the furthest degree within the law. (and maybe a little outside) otherwise they will feel no compunction to observe the law, to our detriment. if we don't excercise our rights they will not be respected. if everyone excercised their rights as this guy did, (and he could have been even more assertive), it would make it more difficult and a disincentive for cops to violate the law and trample on citizens' rights. always FIGHT THE POWER............

Have you guys heard about the recent Supreme Court judgement on the 5th (remaining silent)? Scary stuff all by itself, even without all the other stuff going down.

    http://www.slate.com/articles/news_and_politics/jurisprudence/2013/06/salinas_v_texas_right_to_remain_silent_supreme_court_right_to_remain_silent.html

There are a bunch of articles on this, so if you don't like this source, I suggest looking for others. This is important!
